Terms of Service
Effective date: April 21, 2026
These Terms of Service (“Terms”) govern your access to and use of the website at getwispa.ai and the Wispa AI appointment-setting service (the “Service”) provided by AI Intelligence Score LLC, operating as Wispa (“Wispa,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. The Service
Wispa provides AI-powered software that answers inbound calls, qualifies callers, and books appointments on behalf of your business, including by writing events to connected calendars such as Google Calendar. Features and availability may change over time.
3. Your Data and Third-Party Services
You retain all rights in the data you provide to the Service or that we process on your behalf (“Customer Data”). You grant Wispa a limited license to use Customer Data solely to provide, secure, and improve the Service consistent with our Privacy Policy.
The Service integrates with third-party services (for example, Google Calendar). Your use of those services is governed by their own terms, and you are responsible for ensuring you have the rights necessary to connect them to Wispa.
4. Acceptable Use
You agree not to:
- Use the Service in violation of applicable law, including telecommunications, consumer protection, and privacy laws.
- Use the Service to transmit spam, harassing, fraudulent, or deceptive content.
- Attempt to reverse engineer, decompile, or otherwise derive the source code of the Service, except to the extent such restriction is prohibited by law.
- Interfere with or disrupt the integrity or performance of the Service, including by introducing malware, probing, or unauthorized access attempts.
- Use the Service to build a competing product or to benchmark without our prior written consent.
5. Fees
If your use of the Service is subject to fees, those fees, payment terms, and cancellation terms will be specified in an order form, subscription plan, or other written agreement between you and Wispa. Unless otherwise stated, fees are non-refundable.
6. Intellectual Property
The Service, including all software, content, and trademarks, is owned by Wispa or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in the Service.
7. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 3, 6, 8, 9, 10, and 11) will survive.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any appointment booked through the Service will be kept.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will Wispa or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or related to the Service. Wispa’s aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amounts paid by you to Wispa in the twelve months preceding the event giving rise to the claim or (b) one hundred U.S. dollars ($100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Wispa and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your Customer Data, or your breach of these Terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction and venue in those courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the updated Terms.
